Dick Wolf (Law & Order) has claimed that Arthur Conan Doyle inspired him to create Criminal Intent. Indeed, the brilliant--if socially awkward--Robert "Bobby" Goren (Vincent D'Onofrio) and cool-headed partner Alexandra "Alex" Eames (Kathryn Erbe) do come across like a modern day Holmes and Watson. Rather than England, however, they're members of New York's major case squad. (Trivia buffs may find it of interest that D'Onofrio played Holmes's arch-nemesis Moriarty in the 2002 made-for-cable movie Case of Evil.) The show, which premiered in 2001, added "criminal" to the successful "law" and "order" equation. Each episode moves back and forth between the efforts of Goren and Eames to track down "the worst criminal offenders" and the efforts of the offenders to evade capture. The detectives report to plainspoken Captain Deakins (Jamey Sheridan) and work closely with urbane ADA Carter (Courtney B. Vance). Criminal Intent could hardly be mistaken for a comedy, but it can be lighter on its feet than Law & Order and Special Victims Unit--even if the crimes are just as grim. The fun comes from watching Goren and Eames do whatever it takes to catch the perps. As long as it's legal--they'll do it. Highlights of the first season include "Jones" with Griffin Dunne (An American Werewolf in London) as a philandering lawyer, "Badge" with Viola Davis (Solaris) as a corrupt ex-cop, and "Phantom" with Michael Emerson (The Practice) as a desperate family man. Imagine if you could marry the adventure and acrobatics of the Tomb Raider games to the martial-arts action found in pure fighting games like Tekken. If you have a clear picture of what that would be like, you've got a handle on Oni from Bungie Studios. It's a third-person-perspective action-adventure fighting game, but with a distinct Japanese animation (anime) flavor. The story concerns the TCTF (Technology Crimes Task Force) police sometime in the future. Konoko is an operative with a cybernetic uplink to a little girl android named Shintama. She becomes embroiled in the hunt for a criminal named Muro and his hulking bodyguard, and her battles with his thugs rage through office buildings, chemical plants, an airport, and even the TCTF headquarters itself. It's a simplistic story: high on the melodrama, but perfectly in keeping with its anime intent. Like the story, the action serves that goal as well. Oversized rifles, bizarre rocket launchers, plasma cannons, and freeze guns make up the arsenal, and, should those run out of ammo or get knocked from one's hand, fists and feet complete the set. Konoko can execute a multitude of fairly easy-to-perform flips, combos, and devastating punches and kicks. Combat is fierce and always challenging, yet never dull. The animations are flawless and fun to watch, while never being overly gory or tasteless. Think of the jaw-dropping combat in The Matrix and you've got a taste of Oni's action. The only real flaw is the save-point system used in the game. The game is divvied up into bite-sized chapters, and the game automatically saves at the beginning of each one. There's little reason not to allow one to save anywhere, but our main gripe is that a few of the save points are too far apart. Repeating large sections of the game multiple times becomes a chore and detracts from the game's pace. If you can get past the repetition, you'll find Oni a refreshing kung-fu alternative to the typical run-and-gun action gaming fare. And you'll find Konoko herself a fascinating protagonist to boot (pun intended). --Andrew S. Criminal Negligence - Ignorance Is No Defense
Criminal negligence indicates the lowest level of responsibility or guilt, criminal intention being the highest. Gross negligence and criminal recklessness share the same intermediate level.
What pushes an act over the line from criminal to gross negligence is the fact that the offender COULD foresee the prohibited or criminal consequences of his actions.
Criminal recklessness, on the other hand, indicates the offender knew that he was exposing another person or entity to potential injury. Guilt is determined by the offender's agreeing to run that risk.
Some acts of this crime have more to do with crimes of omission. Guilt is determined by the offender's not foreseeing the results of his actions, allowing otherwise avoidable dangers or consequences to happen.
If the offender deliberately puts himself in a position where he won't be aware of the consequences of his actions, then criminal negligence can turn into willful blindness. Just like willful blindness, "not knowing" is NOT an acceptable defense and the defendant can still be held criminally liable for the results of his actions.
The punishments for this crime vary widely, but incarceration is very common. If the offender is legally declared insane, he may be removed to a state-run facility for treatment purposes.
Criminal Negligence - Common Cases
Criminal negligence also arises from acts that are careless or work that is slipshod. Two common cases of criminal negligence have to do with criminally negligent homicide and negligent child endangerment.
The most controversial cases have to do with slipshod or neglectful healthcare. To prove any 'fault' of any healthcare practitioner (e.g., doctor, nurse, medical technologist, etc.) the plaintiff needs to prove four things:
1. Duty of Care
2. Breach of Standard Healthcare
3. Loss or Injury
4. Causation (link between an offender's action and the resulting loss/injury)
Criminal Negligence - The Greenpeace Case
Another common application of the crime has to do with the culpability of corporations or organizations for the way they do business or implement policies. Oftentimes, violators are charged with criminal negligence even if the full consequences of their neglectful behavior never occur.
In May 2005, Greenpeace was found guilty of criminal negligence resulting from its anti-logging efforts in Alaska. The criminal action resulted from a Greenpeace ship crossing into Alaskan waters without the necessary paperwork.
Carrying over 70,000 gallons of petroleum products, the ship headed for an Alaskan National Forest for its anti-logging campaign. The state of Alaska has laws that require such vessels to file an oil-spill response/prevention plan at least five days before the vessel enters state waters.
Although Greenpeace didn't file the plan within the given period they quickly corrected the oversight. However, the ship's captain was still convicted on three counts of criminal negligence.
Criminal negligence in Alaska has maximum penalties of 12 months in prison and $10,000 for a person and a fine of $200,000 payable by the offending organization.
Needless to say, the penalties would've been much more severe if an oil spill did take place. But this case clearly shows that even a threat of danger due to 'low-level' negligence can be prosecuted in court.
